A California judge ordered on Sunday that television hit series Gossip Girls actress Kelly Rutherford be granted temporary sole custody of her two children Hermes, aged eight, and Helena, aged five. This ruling comes after the children's father went against the current custody agreement and denied Rutherford access to her children unless she handed over their US passports to one of his team. The court order filed on Friday states that the children must be returned to Los Angeles and their mom will keep their U.S. passports.
Rutherford filed for divorce from Daniel Giersch in 2009 after more than two years of marriage. She was also pregnant with the couples second child when she filed for divorce. This led to a bitter custody war. During this time, they shared joint custody. In 2012 the U.S. government revoked Giersch U.S. visa when Rutherford former attorney notified the State Department of allegedly illegal activities by the German national. When this happen, she tried to gain full custody of the children to stay with her in the U. S. but a California judge ruled that the shared custody agreement should remain in force. Due to Giersch revoked Visa, the judge ruled again that the children should live with him in Europe and Kelly should travel to visit them.
After the ruling on Sunday, Rutherford's attorney released a statement to People magazine, 'We are ecstatic, and hopeful that Monaco will respect the California court's ruling and send the children home. Monaco officials know that sending the children back to America is the right thing to do. I'm looking forward to the happy reunion of the children not only with their mother, but also with their country! It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country,' she went on. 'If the citizenship shoe were on the other foot and these children were citizens of Monaco, I have no doubt the United States would respect their right to reside in Monaco.'
